The present General Terms and Conditions of Sale govern the sale of products found on the Kaviaro.com merchant site

The fact that the Customer ticks the box “I have read the general conditions of sale and I accept them” before validating his order automatically entails his express acceptance, without restriction or reservation, of these General Conditions of Sale, to the exclusion of any other document such as a prospectus or catalogue issued by the seller, whose value is indicative only.
Any possible modification of the G.C.S shall only apply to sales concluded after the modification, the dates appearing on the notice of receipt of the order sent to the buyer being authentic.
The site’s offers are exclusively reserved for private and professional customers, to the exclusion of all shops and superstores (hypermarkets, supermarkets, etc.).
Kaviaro.com reserves the right, for any new customer, to ask for proof of identity and residence, before the final validation of his first order.
The site is reserved for the European market. All champagne orders placed on the Kaviaro.com website will be shipped by the Cattier champagne house itself after receiving our order.  The Allspar company reserves the right to modify the shipping method.
Our selling prices are those indicated on the site when ordering. The electronic catalogue is regularly updated.
We reserve the right to change our prices at any time due to promotions, variations in raw materials, prices from our suppliers or due to possible typographical errors in the display of these prices.
All prices are in euros and include VAT. Shipping costs are extra. They vary according to the quantities ordered. The amount of the shipping costs is displayed when you enter the order.
The order must strictly comply with the offer as issued on the site and in particular with the formats, quantities offered and deadlines.
The order assumes that the customer has prior knowledge of these conditions, the price and the essential characteristics of the champagnes and caviars chosen, available on the site.
The order is taken through the “Basket” (dematerialized order form) accessible online on the Kaviaro.com website.
The buyer shall provide the information requested, which is necessary for the order to be carried out. He/she shall take care on this occasion not to omit any information that is essential for the proper execution of the delivery :
Precise information concerning the delivery (delivery address different from the billing address, daytime telephone number, possible access code to the residence, intercom code…)
The buyer is identified by means of his e-mail address.
The buyer accepts the order by clicking on “validate” after having chosen the methods of payment and entered the information requested to enable this in the areas provided for this purpose.
His acceptance is then final, subject only to the possible exercise of his right of withdrawal described below.
Kaviaro.com confirms the order to the buyer by e-mail summarizing the order, a link allowing the follow-up of the order is included in the e-mail.
All orders are considered firm and final upon receipt of payment and confirmation by our services.
Any order of champagne, caviar and accessories can only be validated if it is accompanied by the payment (credit card or bank transfer) of the total price including VAT.
If Kaviaro.com does not receive the transfer within ten days after the order, the order is automatically cancelled.
By credit card, in €euros, (Carte Bleue, Visa, Eurocard/Mastercard) by indicating in the zone provided for this purpose (secure online payment via Paypal) the number of your card, without spaces between the digits, as well as its date of validity and the three-digit security number on the back of your card.
The banking information is encrypted and impossible to decode. Kaviaro.com does not have access to your credit card information, only the e-mail acknowledging the good execution of your payment reaches us.
By bank transfer, in €euros, by indicating the order number (communicated at the end of the order) in the zone provided for this purpose on your bank interface (Recipient message or Reference).
In the event of any delays in payment (card refusal, rejected bank transfer, etc.), it is up to the customer to settle the order by any other appropriate means, failing which the order will be cancelled after 10 days.
Kaviaro.com reserves the property of the sold goods until their complete payment by the buyer (law n° 80-335 of May 12, 1980).
Offers are always made subject to availability. In the event of unavailability of the wines, champagnes and caviars ordered and subsequent cancellation of the order, the price will be reimbursed to the buyer as soon as possible.
In the event of destruction of the goods before the date scheduled for delivery of the order, in the absence of available stock to proceed with its replacement, the buyer will be reimbursed for the sums paid by him, to the exclusion of any other indemnity, within 30 days of the date of the loss.
The order shall specify the place of delivery or, where applicable, the buyer’s wish to collect the goods himself from the seller’s premises. The buyer must receive or collect the goods within a maximum of 5 days following receipt of the order, with the exception of caviar which, once ordered, must be collected on the same day in order to guarantee its quality and preservation. For shipments, the cold chain is guaranteed between 0 and 4 degrees Celsius by the company Chronofrest, a subsidiary of Chronopost.
Any change in the place of delivery must be indicated by the buyer to the seller in good time and in any case before the carrier takes over the order.
The indicative standard delivery time is 7 working days following the day of processing of the validated order (the processing of the order is carried out within 48 hours (working days) of the validation of the latter), from Monday to Friday, between 9am and 6pm, except in exceptional circumstances.
If exceptionally the buyer should notice the absence of delivery within the above-mentioned deadlines, he should immediately notify Kaviaro.com via e-mail or telephone to allow them to remedy the problem as soon as possible, the execution of the order should then take place within 30 days at the latest.
The presentation of the goods at the place and on the date indicated by the buyer releases the seller from his obligation to deliver.
In case of absence of the buyer at the time of presentation of the goods, as far as possible and depending on the circumstances.
If the buyer has chosen to collect the goods or have them collected on the seller’s premises, the goods will only be delivered to the person placing the order. In order to validate his identity, an identity document will be requested. If the person placing the order is unable to visit the premises, he may ask a third party to come in his place. This person must be in possession of a power of attorney drawn up by the person placing the order, to which a copy of one of his or her identity documents must be attached.
The buyer is required to check the condition of the packaging and the contents of the package or packages upon delivery. In the event of damage or lack of conformity, the buyer is obliged to make reservations on the delivery note, specifying the anomalies noted, attach a photo, and notify Kaviaro.com within 24 hours of receipt of wines and / or caviar, by registered letter with acknowledgment of receipt. A right of withdrawal is offered to the buyer under Article L.121-20 of the Consumer Code.
Upon receipt of the goods, the buyer has 14 clear days to return the product to AllSpar and request a refund.
Where the seven-day period expires on a Saturday, Sunday or public holiday, it shall be extended to the next working day.
Products damaged after delivery will not be accepted.
The buyer who makes use of this option shall be obliged to return the goods ordered to the seller’s premises under his own responsibility and at his own expense.
Kaviaro.com cannot be held responsible for any quality deterioration caused by the transport of wine or champagne and caviar.
KAVIARO cannot be held responsible for any loss, damage or failure to deliver an order due to force majeure (such as natural disasters, strikes, road accidents). These cases are in addition to those usually retained by French and Luxembourg or even European jurisprudence.
The Customer Service of Kaviaro.com is at your disposal to settle amicably any problem following an order and its execution. In case of failure to reach an agreement, all disputes arising from the execution of an order or the interpretation of these conditions, and more generally agreements of any kind concluded between the parties, will be attributed to the court of the headquarters of kaviaro.com.
Article L.134-2 of the Consumer Code : it is the responsibility of the kaviaro.com website to keep the written record of the contract concluded electronically for a period of 10 years from the delivery of the goods, as soon as this contract is for a sum of more than 120 euros.
